Legal Penalties Increase for Woman in 30s Over False Rape Claim

A woman falsely accused her supportive father of rape for not giving her money, resulting in a prison sentence.

The Uijeongbu District Court's Namyangju Branch, under Judge Choi Chi-bong, sentenced a woman in her 30s, referred to as A, to 10 months for defamation, business obstruction, and insult charges.

A was charged after making 11 defamatory online posts titled "I am a victim of familial sexual violence" between May and June last year.

She falsely alleged being sexually assaulted by her father from age four and claimed her mother was also abused, demanding severe punishment and stating they settled for damages.

A revealed B's identity and business details, causing him business difficulties.


 


She additionally accused B of remarrying a woman, C, whom she claimed was his affair partner, posting about this six times.

In February 2021, A filed a sexual assault damages lawsuit against B in Incheon District Court but failed to provide evidence.

In court, A maintained her statements were true, but the court disagreed, lacking evidence of habitual abuse by B.

The court found A's claims false, considering B's financial support and her accusation right after he denied a large sum for a cafe.


The court noted her dissatisfaction over financial denial led to false posts, damaging reputations irreparably.


The court cited her continued similar postings as a reoffense risk and victims' demand for severe punishment, influencing the sentence.
